Mega Syndicate Member Terms & Conditions
  1. INTRODUCTION
    1. These terms and conditions govern all persons’ registration with and Subscriptions to Mega Syndicate and all aspects of Members’ transactions with Mega Syndicate.
    2. Individuals acknowledge, by submitting a membership application, that they have read, understood and accept, and that they will be bound by, all of these Terms and Conditions. Individuals must ensure they read these Terms and Conditions carefully.
  2. DEFINITIONS
    1. “Advance Thinking” means Advance Thinking Pty Ltd (ABN 27 135 124 006) of Ivanhoe East, Victoria, Australia, 3079.
    2. “Cut-Off Time” means the latest time that payment of the Subscription Fee must be received by Advance Thinking in order to be entered into that week’s Lotto, as set out in Schedule.
    3. “Identity Verification Procedures” means the set of procedures Mega Syndicate requires Members to complete in order to ensure their compliance with these Terms and Conditions. Guidance on the procedures is available in your 'My Account section' at http://megasyndicate.com.au.
    4. “Kitty” means weekly total value of all valid entries for the week in each Syndicate Group(excluding administrative fees), as outlined in clause 10.2.
    5. “Lottery Game Rules” means the set of rules published by each Lotto provider and approved by the relevant regulatory bodies which dictate how licensed syndicate lottery games operate (e.g. Saturday Lottery Game Rules are available at http://tatts.com/terms-and-conditions/footer).
    6. “Lotto” means any lotto in Australia to which entries are sold on the Mega Syndicate Website (e.g. Saturday Lotto).
    7. “Lotto Syndicate” means the syndicate run on the Mega Syndicate website for an individual lotto (e.g. Saturday Lotto).
    8. “Lotto Syndicate Start Date” differs for each type of Lotto and means the date that entries for a Lotto are available for purchase on the Mega Syndicate Website. These dates will be posted on the Mega Syndicate Website as they come to hand.
    9. “Mega Syndicate” means the business conducted on the Mega Syndicate Website by Advance Thinking.
    10. “Mega Syndicate Account" means a Member’s account accessible via the password protected section of the Mega Syndicate Website only accessible by the Member. Access to a Member’s Mega Syndicate account is available at www.megasyndicate.com.au/users/login.
    11. "Mega Syndicate Website" means www.megasyndicate.com.au and all associated pages linked from this website address that are owned by Advance Thinking.
    12. "Mega Syndicate System Start Date" means the date that the Mega Syndicate will officially start, with the exact date to be advised on the Mega Syndicate Website.
    13. “Member” means any person who has submitted a membership application form at http://megasyndicate.com.au/users/register.
    14. “Selected Numbers” for a Syndicate Group are the twenty (20) numbers ranked highest (based on the method outlined in clause 9) each week for the Syndicate Group,and are the numbers used to determine the tickets purchased for the week for that same Syndicate Group.
    15. “Entry” means a Member’s entry or group of entries into the Mega Syndicate in accordance with these Terms and Conditions.
    16. “Entry Fee” means the fee payable by a Member for the purchase of an Entry. The Entry Fee types are indicated in Schedule A.
    17. “Syndicate Group” means a group of Entries purchased by various Members within the Mega Syndicate which are entered into a given lottery. Advance Thinking will determine which Entries will be entered into each Syndicate Group in accordance with Schedule C.
    18. “Valid Entries” for any given week are any approved Entries whereby the Entry Fee has been received by Advance Thinking by the Cut-Off Time for the week.
    19. “Weekly Fee” means: (a) in relation to a Single Week Entry,the Entry Fee payable for that Entry; (b) in relation a Multi-Month Entry,the Entry Fee determined to be paid on average each week, rounded down to two decimal places (e.g. if Multi-Month Entry Fee is $250 for 6 months, the Weekly Fee is $9.61 (i.e. $250 divided by 26 weeks)).
    20. All dollar amounts refer to Australian currency unless otherwise indicated.
  3. ELIGIBILITY TO REGISTER
    1. Individuals must meet the minimum age requirement for gambling in order to join Mega Syndicate. The minimum age requirement for joining Mega Syndicate in Australia is 18 years. However, the minimum age may be greater than 18 years in any other country/jurisdiction.
    2. When a person submits anapplication for registration, they warrant that they are legally entitled to apply for registration, to deposit funds with Advance Thinking to purchase Entry for Mega Syndicate, and to receive winnings from Advance Thinking through Mega Syndicate, and that their registration, deposit of funds and receipt of winnings from Advance Thinking through Mega Syndicate will not in any way violate any applicable laws of their location or place of residence, domicile or nationality.
    3. Individuals may only make application for registration as a Member:
      1. if they are an individual person (Mega Syndicate Accounts will only be opened in the names of individuals);
      2. if they are at least 18 years of age (or older if so required by any laws applicable in their location or place of residence, domicile or nationality);
      3. if they are not currently excluded or blocked as a Member for any reason; and
      4. where such registration and the opening of a Mega Syndicate Account does not contravene any law applicable in their location or place of residence, domicile or nationality.
    4. Advance Thinking relies upon each person's warranty when it accepts a person's application for registration, opens a Mega Syndicate Account, accepts deposit of funds, and pays a Member any winnings. Each Member indemnifies Advance Thinking from any loss arising from a breach of this warranty or this warranty being incorrect.
    5. Advance Thinking has the right to exclude or block any member, not renew their membership, or refuse/revoke a membership if a member has acted in a way that detriments Advance Thinking's conduct of Mega Syndicate (including but not limited to, publishing offensive material on the Advance Thinking website, manipulating the system in any way to avoid payment, etc).
  4. REGISTRATION
    1. To register, eligible individuals must visit www.megasyndicate.com.au, follow the prompts to the registration page, input the requested details and submit; or use the Facebook/Twitter login function on www.megasyndicate.com.au to register. Individuals must also nominate a username and password in order to login to the Mega Syndicate Website. Members are not able to join Mega Syndicate via any other method. Mega Syndicate hosts one (1) registration page for eligible individuals to apply for membership.
    2. A person will automatically become a Member of Mega Syndicate upon submission of the official membership application form. However, Advance Thinking has the right to review/approve any suspect membership applications in its absolute discretion. Individuals who are successfully registered will receive a welcome email to the email address submitted at the time of registration.
    3. Members will be able to purchase Entries and join Syndicate Groups through Mega Syndicate and be eligible for prizes in the Mega Syndicate.
    4. Upon submission of an application for registration, Advance Thinking will open a Mega Syndicate Account in the applicant's name, and the Member will be able to purchase Entries for a Lotto.
    5. Advance Thinking do not independently verify whether a person is legally entitled to make application for registration as a Member, to make purchases from Mega Syndicate, or to make deposits to a Mega Syndicate Account. When Advance Thinking accepts a membership application for registration, opens a Mega Syndicate Account or accepts offers from a Member for purchases/deposits, Advance Thinking relies upon the Member's warranty that they are legally entitled in their jurisdiction to register with Mega Syndicate, to open a Mega Syndicate Account, to deposit funds with Mega Syndicate, and to make purchases from Mega Syndicate.
  5. SECURITY
    1. When a Member makes application for registration, the Member will be required to nominate a Mega Syndicate Account password. Members are encouraged to choose a strong password and to avoid passwords that would be easy to guess (e.g., birthdates, simple sequences of numbers, dictionary words, names, etc.).
    2. Each Member must enter their correct email address and password in order to access their Mega Syndicate Account.
    3. It is each Member's responsibility to ensure that no other person makes purchases using their registration details on the Mega Syndicate Website. Members must not disclose their password to anyone. Members will be responsible for any use of their Mega Syndicate Account by any other person and Advance Thinking expressly disclaim liability in this regard. If a Member believes or suspects that their password may be known to someone else, the Member must change their password immediately by accessing their Mega Syndicate Account or, if they are unable to access their Mega Syndicate Account, contact Advance Thinking immediately.
  6. EDIT PERSONAL DETAILS
    1. Members may edit their personal details and payment details at any time by logging into their Mega Syndicate Account and following the prompts.
    2. Members are required to update their personal details and contact information recorded in their Mega Syndicate Account promptly whenever this information changes.
  7. IDENTIFICATION AND VERIFICATION
    1. Advance Thinking conducts Identity Verification Procedures in order to verify Member identity and age.
    2. It is a requirement that, when requested by Mega Syndicate,
      1. an applicant for membership must verify their identity and/or age; and
      2. a Member must verify their identity in order to be able to withdraw money from their Mega Syndicate Account or withdraw their Mega Syndicate Account.
    3. If a Member has not verified their identity, any funds held within the Member's Mega Syndicate Account will be held in the Mega Syndicate's business account until such time that the Member can prove their identity.
  8. PURCHASING SUBSCRIPTIONS
    1. Purchases cannot be made by telephone, direct email, mail or in any other manner, other than via the Mega Syndicate Website.
    2. Memberships and Entries are not transferrable. Members are not permitted to purchase Entries on behalf of others, or to resell any Entries issued by Mega Syndicate.
    3. The following Entry types are available:
      1. Single Week Entry (not recurring): Entry into one week of a Lotto Syndicate only. Entry is not recurring.
      2. Multi-week Entry: Option of: (i) 3-month entry (12-week); (ii) 6-month entry (26 weeks); or (iii) 12-month entry (52 weeks). Multi-week Entry for a Lotto allows entry into each week of the Lotto Syndicate, for the length of the Entry. A one-off Entry Fee for Multi-week Entry must be paid in advance.

        When the length of a Multi-Entry expires, the Entry will NOT be automatically renewed and the Member will need to purchase another Entry to remain in the syndicate.
    4. Payment of a Entry Fee may only be made via Poli payments on the Member's Mega Syndicate Account.
    5. Entry Fee for a Single Week Entry and a Multi-week Entry will be dependent on the Lotto type. See Schedule A for current Entry Fees.
    6. Payment of a Single Week Entry and the first payment of a Multi-week Entry must be made via Poli payments at the time of purchase of the Entry, subject to clause 8.9.
    7. Payment must be received by the Cut-Off Time for the Lotto (outlined in Schedule B), to receive entry into that week's Lotto Syndicate. If payment is received after the Cut-Off Time for the week, the Member will instead be entered into the following week's Lotto Syndicate.
    8. If the Mega Syndicate Website, computer system or lottery provider's ticket system experiences any form of malfunction during a Member's Subscription purchase or money/credit withdrawal, or during the Mega Syndicate Website's confirmation of its acceptance of a Member's Subscription purchase/entry into Lotto Syndicate, and Advance Thinking (owner and operator of Mega Syndicate) are unable to recover or verify the status of the purchase/that Lotto Syndicate entry during data recovery, then such unfinished or interrupted Lotto Syndicate entries will be deemed void. Any necessary adjustments will be made to the Lotto Syndicate entry/entries if Advance Thinking reasonably suspects or knows that the Mega Syndicate computer system failed to function in the manner in which it was designed and programmed to function.
    9. Once a Member has completed the checkout process to purchase a Entry, that order is final and cannot be cancelled or amended at the Member's request in any way.
    10. If Advance Thinking is unable to fulfill the relevant Lotto ticket purchases with a lottery provider for any reason whatsoever (including but not limited to the purchaser of tickets being incapacitated due to an accident outside of his/her control, causing a failure to purchase tickets), each Member's Weekly Fee for that given week will be refunded into their Mega Syndicate Account as credit within 24 hours.
    11. Mega Syndicate is not liable for any damages, losses or lost winnings that may arise if an offer to purchase is not successfully fulfilled with the lottery providers for any reason beyond the reasonable control of Advance Thinking.
    12. A Lotto Syndicate entry is deemed not to have been successfully lodged with the lottery provider until such time that the Lotto Syndicate entry is confirmed in writing either within the Member's Mega Syndicate Account or via email to the Member's email address.
    13. All lottery prizes are subject to Mega Syndicate IdentityVerification Procedures. Payment will only be payable to a Member once this process has been completed.
  9. NUMBER SELECTIONS
    1. The quantity and type of lotto tickets and choice of numbers to be included in each lotto ticket will be determined by Advance Thinking in its absolute discretion based on the method set out below. Members will receive confirmation of the numbers selected for a given week via email.
    2. The strategy employed by Mega Syndicate is to purchase all system tickets possible using a random number method. For clarity, this will allow for the same number to appear in multiple system tickets purchased for the same draw.
    3. Members will be sent an email each week with the Selected Numbers that will be used for a set of Lotto tickets purchased for their Syndicate Group as a result of the number selection method by Advance Thinking. The email will be sent after tickets have been purchased for a Lotto. A confirmation of the Lotto tickets purchased each week will also be sent to Members.
    4. In the event that an incorrect listing of the Selected Numbers are sent to Members or posted on the Mega Syndicate Website, Advance Thinking will send a new email containing the correct Selected Numbers used to purchase the Lotto Syndicate tickets for the week.
  10. LOTTO ENTRIES
    1. One or more Syndicate Groups will be created for a Lotto, depending on the number of Valid Entries received for the week, as outlined in Schedule C. Each Entry Group will have a separate allocation of Lotto entries. A Entry will be placed into a Syndicate Group based on the start date for the Entry, with the earliest Entries being entered into the first Syndicate Group. The maximum number of Valid Entries entered into each Syndicate Group is indicated in Schedule C.
    2. Advance Thinking will purchase Lotto entries for each Syndicate Groupup to the weekly total value of the Kitty (i.e., all Valid Entries for the Syndicate Group for the week, excluding administrative fees), calculated as follows:
      • Entry Fees for all single-week Valid Entries for that Syndicate Group for that week; plus
      • Entry Fees paid up-front for Multi-week Valid Entries for that Syndicate Group which are active for that week, divided by the number of weeks for that Entry; minus
      • administrative fees (as set out in clause 12.2).
    3. The combination of system tickets and single tickets purchased for a Syndicate Group each week will be determined by Advance Thinking in its absolute discretion. In determining the type and quantity of tickets to purchase, Advance Thinking will take into consideration: (i) the highest value System ticket that may be purchased based on the Kitty; (ii) the number of single tickets that may be purchased (after purchasing all possible System ticket/s); and (iii) how it can limit the amount of money remaining after all possible tickets are purchased.
    4. Where there is remaining money in the Kitty once all tickets are purchased for a Lotto in a Syndicate Group, the remaining money will be donated to a charity of Advance Thinking's choice. For the exact number and type of Lotto tickets that will be purchased for a given week, please email info@megasyndicate.com.au.
    5. The number and type of tickets purchased for each Syndicate Group will be separate. The numbers used to purchase tickets for each Syndicate Group will only be based on the numbers nominated by Valid Entries in that Syndicate Group.
    6. Any winnings from entries in a Syndicate Group will only be divided amongst Members entered into that Syndicate Group. Entries placed in one Syndicate Group will not be entitled to any winnings from Lotto tickets for another Syndicate Group.
  11. LOTTO RULES
    1. The outcome of Lotto tickets purchased will be determined in accordance with:
      a) the Lottery Game Rules; and
      b) these Terms and Conditions.
    2. If there is an inconsistency in these Terms and Conditions and the Lottery Game Rules, the Lottery Game Rules take precedence to the extent of the inconsistency.
  12. FEES
    1. The types of Entries and their relevant fees are indicated in Schedule A. The Entry Fees specified include all administrative fees (e.g. fees for purchasing tickets, website maintenance fees, payment provider fees, etc).
    2. A set administration fee of $1 will be charged to Members for every $10 of the Entry Fee. This administration fee is included in the Entry Fees.
    3. Members will receive an email and message on their Mega Syndicate Account indicating successful processing of any Entry. In the event that such email/message is not received, Members are advised to contact Mega Syndicate directly as soon as possible prior to the next draw. Purchase details will be indicated on each Member's Mega Syndicate Account.
    4. Multiple Entries may be purchased by each Member. All Entries purchased by a Member will be listed on the same Mega Syndicate Account. Each person must only have one (1) Mega Syndicate Account.
    5. In the event that a payment fails to be processed successfully, Mega Syndicate will automatically alert a Member via email. Members may choose to login to their Mega Syndicate Account and retry payment manually when the relevant funds are available, however, any such payment must be by received by Advance Thinking before the Cut-Off Time for the relevant Lotto. In the event that successful payment is not made before this time then the Entry will not be considered to be valid for the week, the Entry will not be eligible for any winnings for that week, and any numbers nominated for that Entry will not be considered.
    6. Deposits of funds/automatic direct debit transfers for a Member's relevant Entry will only be recognised when Advance Thinking has confirmation from the relevant financial institution that the funds have been credited to the Mega Syndicate bank account.
    7. Members agree to indemnify Advance Thinking against any loss that they may suffer as a result of any deposit made by the Member through payment made via Poli Payments (e.g. if payment is not processed due to Poli payments and not Advance Thinking).
    8. Members should be aware of the terms and conditions relating to the card they are using for any transaction. For example, some institutions may levy a cash advance fee upon transactions through the Mega Syndicate Website and similar merchants. Should this be the case Advance Thinking recommends that Members usea different credit card where a cash advance fee does not apply.
    9. See clause 13 below for fees involved in withdrawal of credit from a Mega Syndicate Account and fees charged before distribution of any prize money.
  13. PRIZE PAYMENTS
    1. Members will be notified of any prize winnings to which they are entitled within 24 hours of the relevant Lotto draw for which their Syndicate Group have winning numbers.
    2. Prizes won by Members will be deposited to the Members' Mega Syndicate Account whereby they may request a withdrawal at their discretion.
    3. The prize money obtained by a winning Syndicate Group will be divided amongst all Members of the winning Group. The prize money will be divided into the number of Members in the winning Group, and each Member will receive the relevant amount rounded down to the next lowest ten cents (e.g. in the event that $2.540444 is the amount calculated after being equally divided amongst all Members of the winning Syndicate Group, each winning Member will receive $2.50). Any remaining money will be retained by Advance Thinking.
    4. A 2% performance fee will be deducted from the total prize money obtained from any division 1 winnings each week and the remaining prize money (subject to the below), will be distributed among the Members of the winning Syndicate Group in accordance with clause 13.3. For all other division prizes no performance fee will be deducted.
    5. Prize money will be distributed to winners within 48 hours of Advance Thinking receiving the payout for the winning, unless otherwise advised due to verification requirements, technical issues or other similar delays.
    6. Prize money will appear as credit in a winner's Mega Syndicate Account. The Member can then choose to leave the credit in their Mega Syndicate Account or withdraw it to their nominated bank account.
    7. In order to make a withdrawal, a withdrawal request must be submitted on the Mega Syndicate Website and the Member must re-enter their account password to confirm the validity of their withdrawal request. The withdrawal order will only be processed once the Member is directed to a page with a message notifying them that the request for withdrawal process has been received.
    8. In the event that the withdrawal amount is less than $100, the Member will be charged a fee of $0.50 per withdrawal. If the withdrawal amount is $100 or more, then there will be no withdrawal fee charged.
    9. In the event that a Member nominates a non-Australian bank account to receive funds withdrawn from their Mega Syndicate Account, an international transfer fee of AU$14 will be deducted.
    10. Except where otherwise specified, Advance Thinking reserves the right to pass on to a Member any fees, costs, charges, taxes, imposts, levies or duties Advance Thinking incurs in transferring funds to that Member's Mega Syndicate Account or credit card account and all Members hereby authorise Advance Thinking to debit such amounts from their Mega Syndicate Account. Members are responsible for all fees, costs, charges, taxes, imposts, levies, duties and exchange rate fluctuations and Advance Thinking are not liable for any loss or costs a Member may incur as a result thereof.
    11. Advance Thinking will not be liable for any delayed or lost mail nor will Advance Thinking be liable if a Member does not receive their withdrawn funds as a result of any incorrect information provided by the Member to Advance Thinking.
    12. Advance Thinking further reserves the right to withhold payments of any nature and to void all winnings of a Member if the Member's registration details are false or misleading.
    13. Advance Thinking further reserves the right to withhold payments of any nature and to void all winnings if a Member is unable to verify their identity via the Identification Verification Process.
    14. It is Members' responsibility to ensure that there are sufficient funds in their Mega Syndicate Account in advance to cover all transactions related to their Mega Syndicate Account, including but not limited to an offer to purchase a Entry and all fees, costs, charges, taxes, imposts, levies or duties for which Members are responsible.
  14. ACCOUNT/SUBSCRIPTION WITHDRAWALS
    1. In the event that a Member has signed up to a Multi-week Entry, the Member can unsubscribe once the paid-for Entry expires (in which case the Member can unsubscribe to avoid automatic renewal in accordance with clause 8.3.2). All payments provided by the Member up until the date they unsubscribe will not be refunded.
    2. Members must unsubscribe at least three (3) days prior to the Cut-Off Time for the Lotto relevant to the Entry to prevent being included in the Entry and to prevent money taken out of their Mega Syndicate Account/credit card account for the Entry.
    3. Mega Syndicate has the right to reject any membership application or remove any Member from Mega Syndicate if the applicant/Member does not provide correct or sufficient proof of identification, tampers with the Mega Syndicate Website, or does anything that may hinder the general operation of Mega Syndicate.
    4. In the event of a Member's death, the balance of the Member's Mega Syndicate Account will automatically form part of the deceased Member's estate. Executors will be required to supply proof of entitlement in a form acceptable to Advance Thinking.
  15. SUSPENSION & TERMINATION
    1. Advance Thinking may suspend or close a Member's Account at any time without notice and without giving the Member any reason.
    2. If Advance Thinking closes a Member's Account, provided that the Member has given Advance Thinking proof of identity, age and place of residence in a form acceptable to Advance Thinking, Advance Thinking will remit to the Member the fund's balance, if any, held in their Account at that time less applicable costs, fees and charges as set out in these Terms and Conditions. If Advance Thinking closes a Member's Account at a time when the Member has paid for a Entry in a Lotto which has not yet been drawn, Advance Thinking will dispense to the Member his/her share of any winnings in those draws, if any, in accordance with clause 13, less applicable costs, fees, and charges as set out in these Terms and Conditions, once the results have been determined. This does not prejudice any right of Advance Thinking elsewhere in these Terms and Conditions or at law to refuse, cancel or dishonour any purchase or offer by a Member to purchase any Entry.
    3. Except as otherwise stated in these Terms and Conditions, in the event that a Member resides outside of Australia:
      • the ordinary rules of foreign exchange applicable in respect of the relevant method of payment and the relevant financial institution will apply to all payments involving conversion of foreign currency; and
      • Members agree to accept any and all foreign exchange fees, costs, charges, taxes, imposts, levies or duties incurred by Advance Thinking in receiving funds deposited by Members or transferring funds withdrawn by Members from their Mega Syndicate Account. Advance Thinking does not make or charge any commission on foreign exchange.
    4. It is each Member's responsibility to make such arrangements as may be necessary for the payment by the Member of any relevant taxes in their place of residence.
  16. RESPONSIBLE GAMING
    1. Advance Thinking is committed to responsible gaming and provides an online link from the Mega Syndicate Website to a gambling counselling resource. Contact details are available by clicking on the Responsible Gaming link on the Mega Syndicate Website.
    2. Advance Thinking may in its sole and absolute discretion permanently exclude a Member from making a purchase or purchases, in which case Advance Thinking will remit the balance of the Member's Mega Syndicate Account to the Member in accordance with clause 15.2.
  17. PERSONAL INFORMATION
    1. When Members make an application for registration they provide Advance Thinking with certain information. It is each Member's ongoing responsibility to inform Advance Thinking of any changes in the information they have given Advance Thinking.
    2. Advance Thinking relies on this information being true and correct and not misleading. If Advance Thinking believe on any reasonable grounds that the information is untrue, incorrect or misleading in any way, Advance Thinking may, in its sole and absolute discretion, cancel a Member's registration or cancel and dishonour any Entries or purchases by the Member or offers to make purchases, and Advance Thinking may, to the extent permitted under law, retain (or recover from the Member) the value of those Entries and any winnings paid to the Member and Advance Thinking may suspend and/or exclude the Member from any further purchases.
    3. By making an application for registration, applicants/Members authorise Advance Thinking to make such enquiries as Advance Thinking considers necessary in its sole and absolute discretion to verify the personal information provided by Members. Members must refer to the Mega Syndicate Privacy Policy for additional details about the use of their personal information.
    4. At the time of Registration, Members may nominate by selecting a tick-box whether they would like to receive promotional and marketing material (including receipt of electronic messages and telephone calls for an indefinite period) from Advance Thinking, and select a separate tick-box indicating whether or not they would like to receive any marketing material regarding Mega Syndicate.
  18. PRIVACY
    1. Mega Syndicate is mindful of privacy concerns by Members and is committed to maintaining the highest possible standards of privacy when handling Members' personal information.
    2. The Mega Syndicate Privacy Policy describes how Mega Syndicate handles Members' personal information. The Mega Syndicate Privacy Policy can be found at https://www.megasyndicate.com.au/static/privacy.
    3. It is agreed and acknowledged by the parties that the terms of the Mega Syndicate Privacy Policy form part of these Terms and Conditions.
    4. Should a Member win a prize, Advance Thinking shall not publish or disclose that Member's identity to any third parties without their explicit prior consent, unless otherwise permitted under the terms of the Mega Syndicate Privacy Policy.
  19. LIABILITY
    1. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Advance Thinking (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of Mega Syndicate.
    2. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Advance Thinking (including its respective officers, employees and agents) will not be liable for any direct, indirect, incidental or consequential loss, loss of a chance, damage (including but not limited to damage for loss of profits, business interruption, loss of programs or information, and the like), expense, claim (including but not limited to any claim attributable to errors, omissions or other inaccuracies in the Mega Syndicate Website and the Mega Syndicate computer system and/or failures in the communications links provided by telecommunications carriers or service providers or between financial institutions and the Megasyndicate.com.au computer system, materials or information downloaded through the Mega Syndicate Website), action or liability of any nature (collectively, "loss") arising out of a Member's registration to and membership with Mega Syndicate, their Mega Syndicate Account, the use by Members or any inability to use the Mega Syndicate Website, any failure of the Mega Syndicate Website, or in any way connected with these Terms and Conditions or the services provided by Advance Thinking (even if the Member has previously advised Advance Thinking of the possibility of such loss). Mega Syndicate Website gives no warranty whatsoever that the Mega Syndicate Website will be available for use by Members permanently or for any minimum period of time.
    3. Members accept the risk of loss arising out of their registration with any membership of Mega Syndicate Website, their Mega Syndicate Account, the purchase or attempted purchase of a Entry, the use or any inability to use the Mega Syndicate Website and the failure of Mega Syndicate Website to give effect to any offer by the Member to purchase an Entry whether accepted by Mega Syndicate Website or not.
    4. Any non-enforcement by Advance Thinking of any of its rights under these Terms and Conditions will not constitute a waiver of those rights. Any waiver by Advance Thinking of any of its rights under these Terms and Conditions will not constitute a waiver on any subsequent occasion.
    5. While considerable care has been taken in compiling and updating content on the Mega Syndicate Website, Advance Thinking does not guarantee the accuracy of such content. To the extent permitted by law, Advance Thinking excludes all warranties in relation to the content and is not liable for any damage, loss, cost or expense incurred by any person using the Mega Syndicate Website.
    6. Advance Thinking cannot and does not guarantee that files available for downloading from the Mega Syndicate Website will be free of viruses, or other codes that may corrupt or destruct properties. Members are solely responsible for implementing virus checking and other procedures to prevent any such corruption or destruction. Files are downloaded and used by members at their own risk.
    7. Subject to any laws in effect, Members agree to indemnify Advance Thinking, its officers, directors, employees, affiliates and suppliers from and against all losses, expenses, damages and costs, including reasonable legal costs, arising out of Members' use of the Mega Syndicate Website and any content on the Mega Syndicate Website or from any violation of these Terms and Conditions (including negligent or wrongful conduct by Members or any other person accessing the Mega Syndicate Website).
  20. MISCELLANEOUS
    1. These Terms and Conditions and the Mega Syndicate Website are not, and should not be understood in any way to be, advertising, promoting or inducing gambling, or publishing gambling information.
    2. If an applicant does not provide all the information requested in the application for registration, except for those fields marked "optional", Advance Thinking cannot process the application.
    3. Employees of Advance Thinking and its associated subsidiaries are prohibited from registering for Mega Syndicate Accounts and purchasing Entries unless for testing purposes as approved by Mega Syndicate management. If entries are purchased via the approved testing procedure and a prize is won, the prize shall be donated to charity and not retained for financial gain of Advance Thinking.
    4. Advance Thinking owns or is licensed to use the copyright in all of the content on the Mega Syndicate Website and by accessing the Mega Syndicate Website, downloading results and purchasing Entries through the Mega Syndicate Website, Members acknowledge such ownership and/or license.
    5. No results file, graphic or other content on the Megasyndicate.com.au site may be reproduced or distributed without the prior written consent of Advance Thinking and Members agree that they will not in any manner interfere with, decompile, modify or create derivative works from any such content or downloads.
    6. Advance Thinking will be entitled at any time and without notice to assign any or all of our rights and duties under these Terms and Conditions. Since Registration is personal to the Member, Members may not transfer, assign or otherwise dispose of their rights and obligations under these Terms and Conditions.
    7. Advance Thinking reserves the right to cancel and/or not award a promotional bonus to an individual if it becomes apparent that an individual or group of individuals is/are attempting to take undue advantage or manipulate the spirit of the promotion. No correspondence will be entered into in relation to any such changes.
  21. JURISDICTION
    1. Members submit to the jurisdiction of the courts of Victoria, Australia.
    2. Members agree not to seek to stay or terminate any proceedings brought in Victoria on the grounds that the forum is not convenient or is less appropriate than some other forum.
    3. Members agree not to challenge any application made by Advance Thinking to stay any proceedings brought in any other jurisdiction.
    4. Advance Thinking strongly advise that Members seek expert legal advice in the jurisdiction in which they are located should they require assistance with, or explanation of, any of these Terms.
    5. If and when Advance Thinking accepts a person's membership application, Advance Thinking is accepting the offer the person has made to Advance Thinking in Victoria, Australia. Members are deemed to receive notification of that acceptance in Victoria and an agreement between the Member and Advance Thinking is formed in Victoria based on these Terms and Conditions and governed by the laws, and subject to the jurisdiction, of the courts of Victoria.
    6. Every time a Member requests the purchase of a Entry, the Member is making an offer to purchase the Entry in Victoria, Australia, pursuant to these Terms and Conditions and, if the request is approved, Advance Thinking are accepting that offer in Victoria.
    7. The laws applicable in a person's location or place of residence, domicile or nationality may prohibit a person from making purchases from Advance Thinking. Some jurisdictions have laws which entirely prohibit people from purchasing certain gambling products over the Internet, other jurisdictions have laws which prescribe minimum age requirements for making lottery purchases, and other jurisdictions have laws which operate in other ways to prohibit people from making purchases from Advance Thinking.
    8. Advance Thinking do not wish to violate any such law nor to allow people to make application for registration or to make purchases from Advance Thinking where doing so would violate any such law. A person must not apply to become a Member or to purchase an Entry if such action would violate any applicable law where that person is located or is resident, domiciled or a national. Individuals must make their own enquiries, and satisfy themselves, before they make application for registration or make purchases from Advance Thinking, to ensure that doing so will not violate any such law.

    1. From time to time, the Mega Syndicate Website may contain links to other sites not operated by Advance Thinking. Advance Thinking does not control those sites and cannot be held responsible for any damages or injury arising out of or resulting from access to or use of such websites. It is individuals' responsibility to check on any guidelines and conditions applicable to such third party websites. Any links provided are for convenience only and are not an endorsement of the companies, organisation or products referred to on the website to which this website links. Such links do not indicate endorsement or support of any goods, services or content on those sites and Advance Thinking will not be liable to any person for any goods, services or content which may be purchased or accessed through links to the Mega Syndicate Website except where supplied by Advance Thinking.
  23. AGREEMENT CHANGES
    1. These Terms and Conditions may be varied at any time in the following manner:
      • Advance Thinking will give Members a Notice setting out the variation and the date on which it will take effect.
      • The Notice will be posted by Advance Thinking on the Mega Syndicate Website and in addition will be communicated to Members by email.
      • Members will be deemed to have received the notice at the time that it is posted on the Mega Syndicate Website or upon its transmission to them by email (whichever happens first). When a person offers to purchase a Entry through Advance Thinking after they have received notice, or are deemed to have received notice, the person is taken to have provided agreement to the revised Terms and Conditions and Advance Thinking's agreement with the Member will be varied accordingly on and from that date.
      • Advance Thinking further reserves the right, at any time and without Notice, to amend the FAQ's and other procedures and explanatory information displayed on, contained in, or accessible from the Mega Syndicate Website.
  24. REFUND POLICY
    1. Tickets will be purchased at the cutoff each Saturday at 1pm (NSW time), any requests for refunds must be received 24 hours prior to this point, in order for your entry to be excluded from that week's draw. Any requests received less than 24 hours prior to ticket purchase will be refused. In addition, syndicate entry purchases/sales are final, so any refund requests received post ticket purchase will also be refused.
  25. DISPATCH AND DELIVERY
    1. If you have a valid entry in Mega Syndicate at the cutoff time for a given week (1pm Saturday NSW time), you will receive a confirmation email by 5pm that Saturday. This email will contain the type of system tickets purchased and the numbers used in your syndicate. There will also be attachments to this email which are screenshots of the confirmation that the lottery provider has provided following successful purchase of these tickets.
